Day off for vaccination against Covid! According to the Law no. 221/2021 for the completion of Law no. 55/2020 on some measures to prevent and combat the effects of the COVID-19 pandemic, published in Official Gazette no. 732 of July 26, 2021, employees in the public and private system who are getting vaccinated benefit, for one paid day off, which is not included in the rest leave, for each dose of vaccine. 

We further present the main changes brought by this normative act:

Persons who are vaccinated against Covid-19 benefit, upon request, the following rights:

  • one paid day off, which is not included during the rest leave, for each dose of vaccine performed, in the case of employees in the public and private system;
  • one day of exemption for attending classes, for each dose of vaccine performed, in the case of pupils and students;
  • one day of leave, for each dose of vaccine performed, in the case of active military personnel and professional soldiers and ranks.

This right will also benefit a parent who must accompany the child (under 18) to vaccination, as shown in the new art. 21 ^ 1 la alin. (3) just introduced in Law no. 55/2020: “benefit from the rights provided in paragraph (1) and one of the parents or the legal representative of the child up to 18 years of age, as well as of the disabled person up to 26 years old, on the day of vaccination the child, respectively the person with disabilities “.

The parent who does not accompany the child to the vaccination must submit a declaration on his / her own responsibility stating that he / she has not requested and will not request days off for accompanying, at the time of the vaccination, the child under 18 years of age, respectively the disabled person. up to 26 years.

The days off for the Covid vaccine are granted based on the vaccination certificate issued according to the law. If the day off coincides with the day of vaccination, the persons have the obligation to submit the vaccination certificate on the first working day after vaccination.

In order not to significantly affect the employer’s activity, employees have the obligation to inform the employer about the days off scheduling options they are going to request under this article, in order to ensure in optimal conditions the functioning of his activity.

The normative act will enter into force starting with July 29, 2021.
