Apprenticeship Graduates: News 2014

The beneficiaries of the law referring to the university graduates apprenticeship are those who have obtained a bachelor degree or similar degree and, upon their professional debut, are being hired based on an individual labor agreement on a job corresponding to their graduated specialty.

The duration of the apprenticeship is of 6 months as from the professional debut.

The G. D. 473/2014 regarding the application norms of the Law no. 335/2013 referring to the university graduates apprenticeship was published.

The rules provide, in addition to defining the beneficiaries of the law, as the apprenticeship is performed by university graduates, referred to as apprentices, under an apprenticeship contract, annex to the labor contract.

There are exceptions to these provisions:

  • The graduates who prove that, prior to graduation, had performed professional activities, according to the law, for a period of six months, in the same occupational field which is receiving training;
  • The graduates for whom the professional debut is regulated through special laws.

The apprenticeship is organized by the employer. Thus, employers are required:

  • to communicate to the Agency for employment in whose area they are located the vacant jobs that will be filled by graduates, according to the methodological norms for applying Law no. 76/2002 regarding the unemployment insurance system and employment stimulation. Under the heading “Remarks” adds the term “apprenticeship”.
  • to communicate the vacancies and all special conditions for these positions when jobs are egulated through special laws.

The apprenticeship period – organization and evaluation

The department manager in which the apprentice is working develops and operates to the approval of the employer the schedule of graduate. Under this program the apprentice activity operates and the assessment is achieved, according to the specific.

The evaluation criteria, established by the employer, shall be made known to the apprentice at the beginning of the apprenticeship period. Also, the employer appoints a mentor who coordinates the graduate and participates in the evaluation.

The evaluation of the graduates is made with 5 working days prior to the termination of the apprenticeship period by an evaluation committee. This committee issues an assessment report (Annex no. 2 of the Norms), under which the employer will issue the graduate a certificate of completion of apprenticeship (Annex no. 4 and Annex no. 5 of the Norms).

The deadline for issuing this certificate is 5 days after termination of the apprenticeship.

Highlights!

The employer is obliged to request the labor inspectorate to stamp the finalization certificate.

The assessment commission / contest commission shall be designated by the employer at least 20 working days prior to the assessment.

Financing the professional debut

The financing of the professional debut shall be done through:

  • employer’s budget;
  • European social fund;
  • Unemployment funds;
  • Sponsorships;
  • Other sources, according to the law.
