The meal tickets are more often the employer option as a benefit to the guaranteed salary.
This benefit can be emitted on paper or electronically and is exclusively for individual food allowance, being paid entirely by the employer, under Article 1 of Law no. 291/2013 published in the Official Gazette, Part I, no. 701 of November 15, 2013.
The number of meal tickets granted in one month cannot be higher than the number of days worked by the employee in the work unit. They are granted monthly and are given in the last decade of each month for the following month by the employer for paper meal tickets.
In case of electronic support, the amount of tickets will be transferred monthly to employees, in the last decade of each month for the following month, electronically, by the meal ticket issuer unit. . Their number corresponds to the number of working days in the month for which the transfer is made under the contract concluded between the employer and the unit issuer.
Therefore, the companies with a work schedule from Monday to Friday will give employees an average of 22 meal tickets reported to a month with 30 days.
It is not considered worked days the periods in which the employees:
- Perform their annual leave;
- Benefit from paid days off;
- Are delegated or detached outside the city where theyhave a permanent place to work and receive daily or monthly allowance of delegation or detachment;
- Are on leave for temporary disability, are absent from work or in other situations established by the employer with employee representatives.
Situation:
An employee who performs overtime is rewarded with a day off next Monday. The employer can reward him with meal tickets? The meal ticket is given for one working day of work or for each day when the employee is present and pursues his activities in the unit?
Solution:
The meal tickets will be given based on the number of days worked in the unit, in the ITM opinion, as a response to the Smartree request.
Therefore, if an employee works on a Saturday and is rewarded according to the collective labor agreement at the company level with a day off during the week, he can receive meal ticket for the Saturday worked in the unit.
ITM also states that in the situation described above, the total number of meal tickets given for a month cannot exceed the number of working days in the month for which the distribution/transfer of the nominal value of meal tickets is made.
