Major changes in the Labor Code! According to the law no. 144/2022 for the amendment and completion of art. 34 of Law no. 53/2003 – Labor Code, in force by May 26, 2022, the General Register of Employees will be accessible online for employees / former employees. The procedure for online access of employees or former employees to the data in the general register of employees will be established within 60 days from the date of entry into force of this normative act, by Government decision.
We present below the main provisions of this normative act:
Modifications are made to the content of the General Register of Employees (art. 34 of the Labor Code), which will include the following: identification elements of all employees, date of employment, position / occupation according to the specification of the Romanian Classification of Occupations or other normative acts, level and the specialty of the completed studies, the type of individual employment contract, the salary, the bonuses and their amount, the period and causes of suspension of the individual employment contract, the period of secondment and the date of termination of the individual employment contract.
The normative act also specifies that the general register of employees is accessible online for employees / former employees, regarding the data concerning them. The right of access is limited to the viewing, downloading and printing of this data, as well as to the online generation and downloading of an extract from the register.
The seniority in work and / or in the specialty can be proved with the extract provided above, under the conditions established by a decision of the Government.
Within 60 days from the date of entry into force of this normative act, by Government decision, at the proposal of the Ministry of Labor and Social Solidarity, the procedure for online access of employees or former employees to the data in the general register of employees is established, the manner of generating and downloading the extract, as well as the conditions under which the extract can prove the seniority in work and / or in the specialty, according to the provisions of art. 34 of the Labor Code.
