Smart Update: Paid Leave Granted for Childcare

As of March 17th, Law No. 19/2020 has come into effect, granting parents paid leave for supervising children in the event of temporary school closures due to a crisis situation declared by the competent authorities in the context of the coronavirus pandemic.

Conditions for Application:

The provisions of the Law apply to parents who meet the following cumulative conditions:

a) They have children up to the age of 12 enrolled in an educational institution or have children with disabilities up to the age of 18 enrolled in an educational institution.
b) Their job does not allow for remote work or telecommuting.

Granting of Paid Leave:

Paid leave is granted upon the request of one of the parents, submitted to the employer of the person who will supervise the child during the period when educational institutions are closed, according to the law. The request must be accompanied by a declaration on their own responsibility from the other parent, confirming that they have not requested paid leave from their workplace as provided by this law.

Payment of the Indemnity for Each Day of Leave:

The indemnity for each day of leave is paid by the employer from the personnel expenses section of the employer’s revenue and expenditure budget. The amount is 75% of the salary corresponding to a working day, but not more than 75% of the average gross salary used for the state social insurance budget.
