New Legislative Changes During the State of Alert

On May 18, Government Decision No. 394/2020 was published in the Official Gazette, Part I No. 410.

This decision removes the obligation for employers to organize work so that it takes place from employees’ homes (an obligation previously established by Decision No. 24/2020 of the National Committee for Emergency Situations).

Therefore, organizing work in telework or work-from-home mode remains a recommended alternative but is no longer an obligation for employers.

Additionally, HG 394/2020 states that the acts issued based on Decision No. 24/2020 of the National Committee for Emergency Situations remain applicable, as long as they do not contradict the provisions of HG 394/2020.

The provisions of Order No. 3577/831/2020 regarding measures to prevent contamination with the new coronavirus SARS-CoV-2 and to ensure the conduct of activities in the workplace under safe and healthy conditions remain valid during the state of alert.
